There is no mention of marriage in the Constitution, which means that decisions on it are reserved to the states and the people.  The people of California voted twice to keep the definition of marriage to mean a union between a man and a woman. The fact that this vote was challenged all the way to the Supreme Court flies in the face of the democratic process, and I agree with Justice Scalia on his dissent.
