Laura Rambeau Lee(1)As a constitutional law professor for ten years, either President Obama does not understand the document or refuses to acknowledge it as the law of the land. The oath of the president of the United States is as follows: “I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States.”

Article II of the Constitution enumerates the powers of the President. Section 3 states: “… he shall take Care that the Laws be faithfully executed, …” The president has no power to make laws or alter existing laws. The Constitution defines the duties of each of the three branches of the federal government. The Legislative branch has the power to make laws and the Judicial branch determines if a law Congress has passed is constitutional or violates the Constitution.

Between his executive orders; his authorization of his cabinet departments to make rules and regulations absent any congressional oversight; his decisions to modify existing laws such as the Affordable Health Care Act; or allow the Department of Justice and the IRS to selectively pursue criminal cases against those deemed to be enemies of the administration; President Obama has absolutely shown he does not feel constrained by the “charter of negative liberties” of the Constitution. Senator Ted Cruz is correct, the president has shown a consistent pattern of lawlessness. Why is no one challenging him?
