The objectives of the three branches of government are very clear.  These objectives are taught in almost any high school government class room.  The job of the legislative branch is to make the laws.  The job of the judicial branch is to interpret the laws.  The job of the executive branch is to execute or carry out the laws created and interpreted by the other branches. To make law by executive order seems a bit presumptuous and is out of line with the objectives of the position of President.  I would suspect if the President attempts to make law via executive order, he will quickly be reminded by the other two branches in effort to maintain a correct balance of power.
